Fenwick Elliott LLP is very proud to act for many of Korea’s major contractors and we have made a commitment to working closely with our Korean clients and developing this area of our practice.

Our lawyers frequently travel to Seoul and we have a permanent Korean representative, Mr Kyung Hee Rhee, who acts as liaison between us and our Korean clients.

We have successfully advised our Korean clients on major construction and energy projects in many countries throughout the Middle East and elsewhere in the world. Countries in which we have advised our Korean clients on projects include Algeria, Abu Dhabi, Dubai, Jordan, Kazakhstan, Korea, Kuwait, Qatar, Libya, Morocco, Oman, and Saudi Arabia.

We are experienced at dealing with both the language issues which can arise with Korean project personnel and with the logistical challenges of the geographical and time differences between London and Seoul or our clients’ project site offices.

Major residential development project, Kazakhstan

Advising a leading Korean developer and contractor on contractual negotiation issues in connection with a proposed residential development project in Kazakhstan.

Power station and desalination plant, Oman

Acting for a top-ranked Korean EPC Contractor in connection with disputes arising from the construction of an independent power and water plant in Oman, including parallel ICC arbitration proceedings with amounts in dispute in excess of US$100 million.

High-rise tower development, Korea

Advising a major Korean developer on specialist subcontract foreign law procurement issues in connection with a major mixed-use high rise development in Seoul.

Integrated security systems for oil and gas installations, Middle East

Advising a leading Korean technology company acting as EPC Contractor for the design, procurement and installation of a fully integrated security system for a Middle Eastern country’s national oil and gas production and processing facilities. Contract value approximately US$500 million.

Power station and desalination plant project, Saudi Arabia

Advising a Korean contractor in defending a claim for approximately US$80 million arising out of the construction of a power and desalination plant in Saudi Arabia.

Independent water and power project

Acting on behalf of a major international EPC contractor during the tender and contract negotiation phase of a large-scale US$2.8 billion power and water project in the UAE and providing project support and claims advice on all legal issues arising during the design and construction phases of the project.

Construction of gas-fired power and desalination plant

Acting on behalf of a major international EPC contractor in connection with disputes arising during the construction of a gas-fired power station and multi-stage flash desalination plant in Kuwait, including ICC arbitration proceedings.

Independent water and power project (IWPP), Saudi Arabia

Acting on behalf of a major international EPC contractor in connection with the first privately financed independent water & power project in the Kingdom of Saudi Arabia. Fenwick Elliott advised on all legal issues arising in connection with the design, construction and commissioning of the project including delay and disruption claims against the project’s owners, inter-consortium disputes and international arbitration proceedings against a key subcontractor.

Construction of combined cycle power station and desalination plant

Acting on behalf of a major international EPC contractor in connection with various disputes and legal issues arising during the construction and commissioning of a 1025MW combined cycle power station and associated desalination plant in Qatar.
