Shetland Islands Council, Re Judicial Review

Shetland Islands Council petitioned for a judicial review of an Adjudicator’s Decision dated 24 June 2011 on the basis that his Decision had been reached in breach of the rules of natural justice. The issues were identical to those raised in the commercial action of the same date, and so for the reasons set out by Lord Menzies in that judgment, he granted the prayer of this petition to reduce the Decision of the Adjudicator.
