John Cothliff Limited v Allen Build (North West) Limited

An Adjudicator made a decision in Cothliff’s favour. Cothliff had asked for costs and the Adjudicator made a decision that Cothliff were entitled to 70% of the costs of the adjudication. On enforcement, the Judge decided that the Adjudicator had power to award costs, at least where, as in this case, costs have been expressly sought in the application placed before the Adjudicator, and where he has allowed representation. As such, the decision was enforced.
