At the world launch of the ICC Expert Rules, 14th January 2015, Nicholas Gould, partner, considered the role and use of experts in international disputes. His talk focused on the difference between party and tribunal appointments and the procedural rules that might apply. The new ICC’s International Rules for Expertise are briefly considered which provide for the proposal of an expert, the appointment of an expert, and the administration of expert proceedings. The expert’s mandate is explored, as are some practical considerations, such as issue identification, timetabling, joint meetings and expert reports.
