A dispute arose in connection with the purported determination of the employment of the contractor under the building contract. His Honour Judge Humphrey Lloyd QC held that the adjudicator had jurisdiction to deal with the underlying basis for the purported determination. In other words, an adjudicator has power to decide whether an extension of time is to be granted under a building contract, provided that the question has to be decided in order to determine the dispute referred to him.
